TINJAUAN HUKUM TERHADAP TINDAK PIDANA PEMBUNUHAN (STUDI KASUS: PUTUSAN NOMOR 114/PID.B/2022/PN.MND)

This article discusses the issue of the criminal act of murder as reflected in Decision Number 114/Pid.B/2022/PN.Mnd. The decision explains that the defendant committed murder by using a knife and stabbing it into the victim’s body. The perpetrator’s motive for committing the murder was that the victim did not allow the perpetrator to help carry chili peppers. In principle, the perpetrator’s actions are reprehensible both under positive law and from a moral standpoint. Legally, the act contradicts the provisions of Article 338 of the Indonesian Criminal Code, which essentially prohibits killing. Morally, the act violates societal norms of decency, not only within Indonesian society but also universally across the world. Such an incident should never have occurred, as it is unreasonable that a trivial issue could lead someone to take another person’s life. Furthermore, from a legal perspective, the perpetrator’s actions are strictly prohibited by law.
