Artikel ini hendak mengkaji isu akibat hukum terhadap pembatalan akta pengikatan jual beli tanah di Kelurahan Kopandakan I Kecamatan Kotamobagu Selatan, Kota Kotamobagu Sulawesi Utara. Isu ini didasarkan pada putusan pengadilan Negeri Kotamobagu Nomor 19/Pdt/2020/PN.Ktg, dalam putusan a quo, tergugat belum melunasi pembayaran cicilan jual beli tanah hingga berakhirnya perjanjian jual beli tersebut. Akibatnya penggugat mengajukan pembatalan perjanjian jual beli tanah tersebut di pengadilan negeri Kotamobagu. Berdasarkan fakta hukum tersebut, secara hukum tindakan pengajuan pembatalan oleh tergugat tersebut, dapat dibenarkan. Sebab, Pasal 320 jo Pasal 1234 KUHPerdata menegaskan bahwa apabila telah disepakati adanya perjanjian suatu hal tertentu namun jika tidak dilaksanakan, maka perjanjian tersebut batal demi hukum (null and void). Meski demikian, pengajuan pembatalan harus dilakukan oleh pihak yang merasa dirugikan akibat ingkar janji oleh pihak lain di pengadilan.

Abstract

This article would like to examine the issue of legal consequences of the cancellation of the deed of binding sale and purchase of land in Kopandakan village I south Kotamobagu District, North Sulawesi Kotamobagu City. This issue is based on the decision of the Kotamobagu District Court Number 19/Pdt/2020/PN.Ktg, in the A quo decision, the defendant has not paid off the installment payment of the land sale and purchase until the end of the sale and purchase agreement. As a result, the plaintiff filed a cancellation of the land sale and purchase agreement at the Kotamobagu District Court. Based on these legal facts, legally the act of filing an annulment by the defendant, can be justified. This is because Article 320 in conjunction with Article 1234 of the Civil Code confirms that if a certain agreement has been agreed, but if it is not implemented, the agreement is null and void. However, the application for cancellation must be made by the party who feels aggrieved due to the failure of the promise by the other party in court.
